Mt. Gile's Famous eGift Card

GIFT CARD TERMS AND CONDITIONS

Mt. Gile’s Famous, LLC hereby grants you access to purchase, use, and/or assign to a designated recipient the Gift Card, solely for your own purposes and subject to any and all limitations. Mt. Gile’s Famous, LLC Gift Cards may not be resold or offered for sale at any location, physical or virtual, or by any individual, entity, business, or a representative of any individual, entity, or business unless authorized by Mt. Gile’s Famous, LLC.

Gift Cards

Unless otherwise required by Applicable Laws, the Gift Card:

(i) funds never expire;
(ii) is not reloadable;
(iii) is not redeemable for cash;
(iv) does not include any activation fees or added service fees, or fees that reduce the value of the card over time;
(v) cannot be used to purchase additional Gift Card(s);
(vi) cannot be used in conjunction with installment payment options;
(vii) is in compliance with applicable laws; and
(viii) is single-use and may only be used at Mt. Gile’s Famous, LLC locations, including www.mtgiles.com, for purchase of goods from Mt. Gile’s Famous, LLC and no other merchant or company.

Available Balance For balance inquiries, please retain your Gift Card number and contact Mt. Gile’s Famous, LLC.

Returns or Refunds Once issued, Mt. Gile’s Famous, LLC Gift Card may not be returned or canceled.

Lost or Stolen Gift Cards Gift Cards will not be refunded if lost or stolen. Please retain your Gift Card number and contact Mt. Gile’s Famous, LLC immediately if you suspect that your Gift Card has been lost or stolen.

Delivery Information Gift Cards are delivered via email. You are responsible to provide the correct email address to ensure successful delivery. Mt. Gile’s Famous, LLC is not responsible for undeliverable Gift Cards or Gift Cards that are not received due to inaccuracies in the provided email address.

Failed Delivery If Gift Card has not been received and the provided email address has been confirmed as accurate please check the following as some possible reasons: Spam filter settings and/or captured in spam folders; firewall settings; inbox limitations.

LIMITATIONS
A. Indemnification Purchaser and Gift Card recipient(s) will defend, indemnify and hold Mt. Gile’s Famous, LLC and its respective officers, directors, employees, agents and suppliers harmless from and against all claims, actions, proceedings, damages, losses, judgments, settlements, penalties, fines, costs and expenses (including attorneys’ fees) arising from any third-party claim in connection with (a) your breach of any obligations; (b) your negligence or willful misconduct in connection with your performance of your obligations; (c) your violation of Applicable Laws; (d) the Gift Card, including any unfunded Gift Card balance or fraudulent activity, unauthorized use or losses related to or associated with a Gift Card or recipient(s); or (f) any obligations you owe to any third party or Gift Card recipient(s).

B. Limitation of Liability Mt. Gile’s Famous, LLC financial liability for the Gift Card shall not exceed the amount paid to Mt. Gile’s Famous, LLC for the Gift Card, which is equal to the original issued value of the Gift Card by the original purchaser. Mt. Gile’s Famous, LLC is not responsible for any losses or liability associated with the Gift Card or for items purchased with the Gift Card.
